These policies explain how CyberDivine works, your rights, and how we protect your data while building consented synthetic humans.

Terms of Service

Welcome to CyberDivine, a consent-first platform for creating and managing synthetic human personas. By accessing our website, requesting an invite, or using any CyberDivine services (collectively, the “Services”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Services.

1) Key Definitions
  • “Synthetic Persona” means an AI-driven representation of a person’s voice, style, memories, preferences, or other attributes, generated from user-provided materials and configured settings.
  • “User Materials” means information you provide, including email, text responses, audio/video, images, and metadata.
  • “Licensing” means authorized access by third parties to interact with or use a Synthetic Persona, subject to permissions and fees.
2) Eligibility & Invite-Only Access

The Services are currently invite-only and intended for individuals 18+ with capacity to contract. Submitting your email does not guarantee selection. We may deny or revoke access at our discretion, consistent with applicable law.

3) Application & Fees

You may request an invite by submitting a valid email and agreeing to the Terms and Privacy Policy. We may charge a non-refundable application or onboarding fee, which may be waived for limited periods. No collection of sensitive media occurs until after selection and execution of separate consent and licensing agreements.

4) Consent & User Responsibilities
  • You represent that your User Materials are accurate, lawful, and that you have the rights necessary to grant CyberDivine the permissions described herein.
  • You will not upload or instruct us to use content that is illegal, defamatory, infringing, or that violates the rights of others.
  • You agree to comply with all usage rules, community standards, and applicable laws.
5) Licenses You Grant to CyberDivine

By providing User Materials, you grant CyberDivine a limited, revocable, non-exclusive, worldwide license to use, reproduce, process, and create derivative works from your User Materials solely to evaluate your application, communicate with you, and—if you are selected and separately consent—develop, host, and operate your Synthetic Persona in accordance with your permissions. Additional, more specific licenses (e.g., right of publicity, voice likeness, commercial use) will be set out in a separate consent and licensing agreement prior to any commercial use.

6) Ownership
  • You retain ownership of your User Materials and, as applicable, personal rights such as name, image, likeness, and voice.
  • CyberDivine owns the Services, platform, models, and any non-personal system improvements or analytics created from operating the Services.
  • Outputs generated by a Synthetic Persona may be subject to separate ownership or licensing rules defined in the consent and licensing agreement.
7) Permissions, Controls & Revenue Share

You will be able to configure permissions (e.g., advertising, research, entertainment, political content). Political content is disabled by default. Licensed use of your Synthetic Persona will follow your active permissions and, where applicable, pay a revenue share to you based on the use case and any exclusivity. CyberDivine may charge platform and processing fees. Details will be provided in your dashboard and in the licensing agreement.

8) Prohibited Uses
  • No unlawful, harassing, hateful, or deceptive content.
  • No attempts to re-identify, extract, or misuse other users’ data or personas.
  • No political content or endorsements without explicit, opt-in permissions and compliance with law.
9) Termination, Revocation & Deletion

You may request to revoke permissions, freeze further training, or delete User Materials and your Synthetic Persona as permitted by law and the technical limits of deployed models. We will honor valid requests and will disclose realistic constraints (e.g., previously distributed model artifacts or licenses may not be fully retractable). CyberDivine may suspend or terminate access for violations of these Terms or to protect users and the platform.

10) Disclaimers

The Services are provided “as is.” We do not warrant uninterrupted or error-free operation, or that Synthetic Personas will perfectly reflect a person’s identity or views. We are not liable for third-party systems, outages, or misuse by others, though we will take reasonable steps to address violations we identify or that are reported to us.

11) Limitation of Liability

To the fullest extent permitted by law, CyberDivine and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. In all cases, our aggregate liability will not exceed the greater of (a) amounts you paid to us in the 12 months preceding the claim, or (b) $100.

12) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Illinois, excluding conflicts of law principles. You agree to resolve disputes through binding arbitration on an individual basis, except where prohibited by law. Nothing here prevents either party from seeking injunctive relief to prevent misuse of data or intellectual property.

13) Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated via the website or email. Your continued use of the Services after changes become effective constitutes acceptance.

Privacy Policy

Your privacy and control come first. This Privacy Policy describes what we collect, how we use it, and your rights. This policy applies to our website and invite application process; additional, detailed data-use terms will apply if you are selected and onboard into the program.

1) Information We Collect
  • Application data: email address, consent checkbox, timestamps, IP/country (for abuse prevention).
  • Communications: emails you send us, support requests, and our replies.
  • Site analytics: minimal telemetry (e.g., page views, device type) via privacy-conscious tools; no cross-site tracking ads.
  • Future onboarding (if selected): only with your explicit consent — e.g., audio samples, written responses, photos/videos, preferences, and licensing choices.
2) How We Use Information
  • Process your invite request and contact you if selected.
  • Operate, maintain, and improve the website.
  • Detect abuse and maintain platform security.
  • If you opt in: send program updates or policy changes. You may unsubscribe anytime.
  • For selected users (with separate consent): develop, host, and manage your Synthetic Persona per your permissions.
3) Legal Bases (where applicable)
  • Consent (e.g., invite emails, onboarding).
  • Contract (providing Services you request).
  • Legitimate interests (security, site analytics, preventing fraud).
  • Compliance with legal obligations.
4) Sharing & Disclosure
  • Vendors: hosting, email delivery, analytics—bound by data processing terms and confidentiality.
  • Legal: to comply with law or protect rights, safety, or the platform.
  • No sale of personal data. We do not sell your personal information.
5) Cookies & Analytics

We use strictly necessary cookies for security and session basics. We may use privacy-centric analytics (no third-party ad beacons). You can control cookies via your browser settings (Cmd/Ctrl + , for many browsers).

6) Data Retention

Application emails are kept while the invite program runs and for a reasonable period thereafter, then deleted or anonymized. If selected, retention for onboarding materials will be specified in your consent and licensing agreement and dashboard settings.

7) Your Rights
  • Access, correction, deletion, and portability (subject to verification and legal limits).
  • Withdraw consent at any time (does not affect prior processing lawfully based on consent).
  • Opt out of non-essential emails.
8) Security

We use encryption in transit, hardened storage, access controls, and audit logging. No system is perfectly secure; we continually improve our safeguards and will notify you of significant incidents as required by law.

9) International Transfers

If data is processed outside your jurisdiction, we use lawful transfer mechanisms (e.g., Standard Contractual Clauses) where required.

10) Children

The Services are not intended for individuals under 18. We do not knowingly collect children’s data.

11) Changes to this Policy

We may update this Privacy Policy from time to time. Material changes will be announced on this page and, when appropriate, via email.
